By making a booking, accepting a quotation, or allowing work to begin, the customer agrees to be bound by these terms. They are intended to create a clear and fair framework for both parties, covering the booking process, payment arrangements, cancellations, liability, waste handling, and the law that applies to the service.

Throughout these terms, references to “we”, “us” and “our” mean the gardening service provider, and references to “you” and “your” mean the customer or person authorising the work. These terms apply to garden maintenance, planting, pruning, lawn care, clearance, seasonal tidying, and related services offered by Gardeners in Wapping.

We recommend that you read these terms carefully before confirming any arrangement. If any part of these terms is unclear, it is your responsibility to ask for clarification before the work starts. Any variation must be agreed in writing. Nothing in these terms affects your statutory rights as a consumer where such rights apply.

1. Booking Process

All bookings are subject to availability and acceptance by us. A booking may be made after we have received sufficient details about the property, the required gardening service, and any access or safety considerations. We may ask for photographs, dimensions, or further information to help assess the work. For larger or more complex jobs, a site visit may be required before a quotation is confirmed.

Any quotation provided by Gardening Services Wapping is based on the information available at the time and may change if the scope of work, site conditions, or access details differ from those described. A quotation does not become binding until it is accepted by both parties or until we confirm the booking in writing. Acceptance may be communicated by email, message, or another written form agreed by us.

Customer booking confirmation for gardening servicesWhen you make a booking, you confirm that you are authorised to allow work to be carried out at the property. You must ensure that all relevant information is accurate and complete, including any known hazards, pets, shared access arrangements, or restrictions affecting the garden. We may refuse or postpone work if the conditions are unsafe, if access is not available, or if the details provided are materially incomplete.

2. Scope of Services

The exact service to be delivered will be limited to what is described in the accepted quotation, work order, or written confirmation. If additional tasks are requested once the job has started, we may agree to carry them out, but they will be treated as extra work and may be charged separately. This applies to all services provided by our gardeners in Wapping, including routine maintenance and one-off projects.

We will use reasonable skill and care in performing the agreed work. However, gardening results may depend on weather, season, plant condition, soil quality, previous maintenance, and other factors beyond our control. We do not guarantee that particular plants will survive pruning, transplanting, treatment, or relocation unless we have expressly agreed a specific guarantee in writing.

You acknowledge that some work may expose pre-existing defects, hidden damage, poor growth, or underlying issues that were not visible before the service began. Gardeners Wapping will not be responsible for problems that existed before our involvement unless we have caused them directly through negligence.

3. Payments and Charges

Prices are usually set out in the quotation or booking confirmation. Unless stated otherwise, prices are quoted exclusive of any applicable taxes or additional disposal charges. If the work takes longer than expected because of inaccurate information, restricted access, or a change in scope, we may adjust the charge accordingly. Any material variation will normally be explained before extra work is undertaken.

Payment terms will be specified at the time of booking. For regular maintenance, we may require payment on completion of each visit or on a recurring invoice basis. For larger jobs, a deposit may be requested before the work is scheduled, with the balance due on completion or within the stated invoice period. We reserve the right to suspend or cancel work if payment is overdue.

Unless otherwise agreed, invoices must be paid in full without deduction or set-off. Where a payment fails, is reversed, or is not received by the due date, we may charge reasonable recovery costs and interest to the extent permitted by law. Any discounts or promotions are offered at our discretion and may be withdrawn at any time before booking confirmation.

4. Cancellations, Rescheduling, and Access

You may cancel or reschedule a booking by giving us reasonable notice. If you cancel after the work has been reserved for your appointment, we may charge a cancellation fee to cover lost time, preparation, or any special arrangements already made. The amount of any fee will depend on how much notice is given and the level of commitment already incurred.

If we need to cancel or reschedule because of adverse weather, staff illness, equipment failure, unsafe conditions, or other circumstances beyond our control, we will aim to offer an alternative appointment. Gardeners in Wapping will not be liable for inconvenience caused by such changes, provided we act reasonably and communicate the position promptly.

Green waste collected after a gardening jobYou must ensure that we can access the property on the agreed date and time. If access is not available, if keys or entry instructions are not provided, or if the site is otherwise inaccessible, we may treat the visit as cancelled by you and apply a reasonable charge. Where a third party controls access, you remain responsible for making the necessary arrangements.

5. Liability and Responsibility

We will take reasonable care when performing all services, but our liability is limited to losses that are foreseeable and directly caused by our failure to exercise reasonable skill and care. We do not exclude liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded under UK law.

We are not responsible for indirect or consequential losses, including loss of enjoyment, loss of profit, loss of business, or any deterioration caused by pre-existing garden conditions, hidden defects, pests, disease, or adverse weather. Where plants, turf, soil, or materials are supplied by you, we are not liable for failures caused by poor quality, unsuitable selection, or incorrect storage unless we have expressly advised otherwise.

Any estimates of time are approximate only. If a job takes longer because of unexpected conditions, additional safety measures, or changes requested by you, this will not be treated as a breach of contract. Gardeners Wapping is also not liable for damage arising from the natural movement of materials, settlement of soil, or ordinary wear and tear in the garden environment.

6. Waste Regulations and Green Waste

All waste removed during the provision of gardening services will be handled in accordance with applicable UK waste laws and environmental requirements. This includes green waste, soil, branches, leaves, and other garden materials. We will transport and dispose of waste only where this has been agreed or where disposal is included in the service description.

You acknowledge that some materials may require special handling, separation, or disposal charges, particularly if they contain contaminated matter, treated timber, old fencing, builders’ waste, or non-garden items mixed with green waste. We may refuse to remove any waste that we reasonably believe is hazardous, unlawful to transport, or not properly described in advance.

Where waste is left on site for collection by a third party or placed into your own containers, responsibility for that waste transfers to you once our work is complete and we have departed, except where we have expressly agreed to remain responsible. If we provide waste transfer documentation or similar records, you must retain them if required for compliance purposes.

7. Customer Obligations

You agree to provide a safe working environment and to inform us of any known risks before work starts. This includes underground services, fragile structures, hidden water features, uneven surfaces, aggressive animals, or areas that should not be entered. You are responsible for securing valuables, removing breakable items, and protecting any features that may be damaged by normal gardening activity.

If you request work on plants, structures, or surfaces that are already weak, unstable, diseased, or near failure, you accept that the service may reveal or worsen the condition even when performed with care. We may decline to proceed if, in our opinion, the risk of damage or injury is too high. This is part of our standard approach as gardeners in Wapping, designed to protect both property and personnel.

You must also ensure that all approvals, permissions, and consents required for the work are in place, including where the property is leasehold, shared, or managed by a third party. We are entitled to rely on your instructions unless we have reason to believe they are incorrect or unauthorised.

8. Complaints and Remedy

If you are dissatisfied with any aspect of the service, you should raise the issue as soon as reasonably possible after the work is completed. We may ask for photographs or other information to help review the matter. Where appropriate, we will inspect the issue and, if we agree that the service fell below the required standard, we may offer a remedy such as a return visit, partial correction, or an appropriate adjustment.

We will not be responsible for complaints raised long after the work was completed where we have been deprived of a fair opportunity to inspect the concern, identify its cause, or mitigate further loss. Any remedy offered will be at our reasonable discretion and will not exceed the value of the specific service affected, unless otherwise required by law.

However, you agree that minor variations in appearance, growth response, and finish are normal in gardening work and do not automatically amount to a breach of contract. Seasonal conditions and natural variation may affect the appearance of the garden after service.

9. Governing Law and General Terms

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or connected with the services, the quotation, or these terms will be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer law provides otherwise.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. No failure or delay by us in enforcing any right shall operate as a waiver of that right. Any variation to these terms must be agreed in writing and signed or confirmed by both parties.

These terms are intended to apply alongside any service-specific terms set out in a quotation or work order. If there is a conflict, the written quotation or work order will prevail to the extent of the inconsistency. By proceeding with a booking, you acknowledge that you have read, understood, and accepted the terms applicable to Gardeners Wapping and the related gardening services.
